Notarial Terms of Service
1. Services Covered
These Terms & Conditions apply to all services, including but not limited to: traditional in-person notarizations, mobile notary travel services, loan signings and real estate closings, electronic notarizations (eNotary), Remote Electronic Notarization (REN) effective July 1, 2026, as well as printing, scanning, and document return services.
2. Not Legal Advice / No Document Preparation
The Company does not serve as an attorney and does not provide legal advice. We do not recommend which documents to sign, interpret the legal implications of documents, draft or modify forms, offer immigration legal services, or represent clients in legal matters. It is the client's responsibility to understand their documents and seek appropriate legal counsel if needed.
3. Identity Verification & Signer Requirements
All signers must be physically present as required by law (or comply with REN/eNotary requirements), present a valid government-issued photo ID, be able to communicate with the notary, and appear willing and aware. The Company reserves the right to refuse service if the ID is missing, expired, or deemed unacceptable, if capacity is questioned, if coercion is suspected, if the document is improper, or if the requested notarization is not legally permitted.
4. Document Requirements
You agree that all documents must be complete and provided prior to the appointment when requested. The Company may refuse to notarize documents that have missing pages, prohibited blanks, or suspicious alterations. We do not guarantee the acceptance of notarized documents by any receiving agency.
5. Fees, Travel, and Convenience Charges
Fees may include state-regulated notarial fees (up to the maximum allowed by law), mobile travel/convenience fees based on distance, time, location, after-hours scheduling, and parking/tolls, as well as additional service fees for printing, scanning, shipping, waiting time, multiple signers, and extra documents. Mobile service includes a separate travel fee, quoted in advance based on location, time, and distance. Appointments outside normal business hours or time-sensitive requests will include a convenience fee, quoted in advance.
6. Payment Terms
Payment is due before or at the time of service (prior to notarization) unless agreed otherwise in writing. Accepted payment methods may include cash, card, Zelle, CashApp, ACH, or other approved options. Returned payments, chargebacks, or disputes may incur additional fees and collections processes. A 3% processing fee applies to all credit/debit payments, which can be avoided by using cash or payment methods such as Zelle or Apple Pay.
7. Cancellations, Rescheduling & No-Show Policy
Cancellations made within [24] hours may incur a $50 cancellation fee. No-shows may be charged up to the full travel/convenience fee. If the notary arrives and the signer cannot proceed due to missing ID, incomplete documents, or refusal to sign, applicable fees will still apply. Notarial fees are non-refundable once the service is completed.
8. Waiting Time Policy
Appointments come with a grace period of 10 minutes unless stated otherwise. Waiting time may incur a charge of $1 per minute. If delays prevent completion, the appointment may be canceled and treated as a no-show.
9. Loan Signings
For loan signings and closings, the Company facilitates only the signing and notarization processes and is not responsible for errors made by lenders/escrow, document mistakes, or funding delays. The customer agrees to follow the signing instructions given by title/escrow/lender. Requirements for scanbacks, deadlines, and package returns must be disclosed at the time of booking.
10. Electronic Notary / Remote Electronic Notarization (REN)
For electronic or remote notarizations, you must have compatible technology, and identity verification may include credential analysis and knowledge-based authentication. Sessions may be recorded to comply with legal requirements, and platform/provider fees may apply. The Company is not liable for technical failures beyond its control.
11. Refusal of Service
The Company reserves the right to refuse service for unlawful, suspicious, or improper requests; if the signer lacks valid ID or capacity; if a conflict of interest exists; or if the situation does not comply with applicable laws. We take our responsibilities seriously, conducting notarizations with the highest standards of integrity. By adhering to these guidelines, we protect both the signer and the notary, ensuring secure and legitimate processes.
If a signer appears under duress or does not fully understand the document, we will decline service. It's our duty to ensure all parties are willing participants and that the notarization process is not misused. We encourage signers to come prepared and uphold the standards of the North Carolina Notary Public Act.
12. Limitation of Liability
To the maximum extent allowed by law, the Company is not responsible for any document rejections from third parties, missed deadlines due to customer delays, or losses arising from inaccurate information provided by the customer. Additionally, the Company disclaims liability for indirect or consequential damages. In the event that liability is established, it will be limited to the total fees paid for the notarial act(s) that led to the claim.
13. Privacy & Recordkeeping
Notaries may be required to maintain journal entries and gather personal data to adhere to legal standards. All information will be kept confidential, except as mandated by law.
14. Safety & Location Requirements (Mobile Services)
The customer agrees to ensure a safe environment with appropriate lighting and unrestricted access. The Company reserves the right to leave immediately if any safety concerns arise. Please note that travel fees may still apply.
15. Governing Law
These Terms & Conditions will be governed by the laws of the State of North Carolina, unless services are provided in another state where local laws apply.
16. Acceptance
By booking, requesting services, or making a payment, the customer explicitly acknowledges and agrees that these Terms & Conditions constitute a binding agreement applicable to all notary, mobile notary, signing agent, and electronic notary services provided.
